Provider
RedSwiss Sign (sign.redswiss.ch) is operated by Anthony Thomas, a private individual resident in Switzerland. Contact: info@anthony-thomas.ch.
Purpose
RedSwiss Sign lets you upload documents, invite signers, have them sign online and obtain a final document with a certificate and audit trail. These terms apply to any use of the service.
Type of signature
RedSwiss Sign provides a simple electronic signature (SES). It is not a qualified electronic signature (QES) within the meaning of the Swiss Federal Act on Electronic Signatures (ZertES).
Where the law requires written form, only a qualified electronic signature is equivalent to a handwritten one (art. 14 para. 2bis of the Swiss Code of Obligations). It is up to you to check that a simple electronic signature is suitable for the document concerned.
Account
You provide accurate information, keep your credentials confidential and are responsible for actions taken from your account. We recommend enabling two-factor authentication.
Use of the service
You warrant that you hold the necessary rights to the documents you upload and that you use the service lawfully. Using it for unlawful or fraudulent content, or content that infringes the rights of others, is prohibited.
Signers are identified through access to their email address and a verification code. RedSwiss Sign does not verify their identity beyond that.
Signers
People invited to sign do not need an account. By signing, they accept these terms as regards the signing process, as well as the processing of their data described in the privacy policy.
Plans and payment
A free plan and paid plans are offered as shown on the Pricing page. Paid plans are billed in advance for each period and paid through Stripe.
You can cancel at any time; cancellation takes effect at the end of the current, already paid period, which is not refunded unless required by law. We may change prices with at least 30 days' notice.
Availability
We do our best to keep the service available and reliable, but we do not guarantee uninterrupted availability, in particular during maintenance or outages.
Liability
To the extent permitted by law, our liability for slight negligence is excluded. It is never excluded for intent or gross negligence (art. 100 of the Swiss Code of Obligations). We are not responsible for the content of documents or for the legal validity of a signature for a given use.
Ending use
You can stop using the service at any time and request deletion of your account at info@anthony-thomas.ch. We may suspend or close an account if these terms are breached.
Changes
We may change these terms. For significant changes we will inform you in advance by email or on the website. If you keep using the service after the changes take effect, you accept them.
Governing law and jurisdiction
These terms are governed by Swiss law. The place of jurisdiction is the provider's place of residence, subject to mandatory places of jurisdiction under the law, in particular for consumers.
